Virginia Man With 4th Amendment Written on Chest Sues Over Airport Arrest

4th AmendmentDavid Kravets writes on WIRED’s Threat Level:

A 21-year-old Virginia man who wrote an abbreviated version of the Fourth Amendment on his body and stripped to his shorts at an airport security screening area is demanding $250,000 in damages for being detained on a disorderly conduct charge.

Aaron Tobey claims in a civil rights lawsuit (PDF) that in December he was handcuffed and held for about 90 minutes by the Transportation Security Administration at the Richmond International Airport after he began removing his clothing to display on his chest a magic-marker protest of airport security measures.

“Amendment 4: The right of the people to be secure against unreasonable searches and seizures shall not be violated,” his chest and gut read.

The University of Cincinnati student didn’t want to go through the advanced imaging technology X-ray machines that are cropping up at airports nationwide. Instead, when it was his turn to be screened, he was going to opt for an intrusive pat-down — and remove most of his clothing in the process.

    People need to stfu and get over this whole TSA thing.

    Put it this way. If the TSA stopped doing their jobs and left the airports, like every idiot wants, and there happens to be another terrorist attack on airlines, those same idiots would start an uproar about how America doesn’t take precautions ect..

    Honestly, be a man and suck it up. Get the screening and/or pat down. You are going to complain anyway it goes.

      • You are aware that once you start willingly giving up your rights you essentially have none, yes? What rights we have should never be surrendered, for any reason. The body scanners aren’t really needed. We already x-ray all luggage, have metal detectors AND have air marshals on flights just in case someone manages to get something onto the plane they shouldn’t have. Body scanners are intrusive and unnecessary.

      Ben Franklin once said: “Do not trade your basic freedoms for a false sense of security, for soon you will lose both”.  
      Passing through a metal detector is one thing, but the scanners and pat downs of children and plastic baggies and throwing out baby food and contaminating breast milk and everything else is just too much.
      How did we ever manage to fly commercially for 60 years before the TSA came along? Didn’t EVERY SINGLE AIRCRAFT GET BLOWN OUT OF THE SKY???

    1) Scanners do not detect thin plastic explosive or liquids reliably. Just hard/bulky objects.

    2)
    Scanners cannot detect anything carried “internally.” Hey, if you’re
    not willing to stick a bomb up your ass, you’re not a terrorist.

    3)
    Airport flight-line staff are not screened at all. Anyone getting a job
    there, or stealing the ID of workers can gain access to planes.

    4) Air cargo, often carried aboard commercial aircraft, are only spot checked.

    5)
    Airport perimeters have next to no security at all. Anyone breaching
    the fence-line with the right appearance/uniform has free access.

    6)
    TSA employees are recruited from the bottom of the labor pool & are
    easily conned/bluffed past. You can con your way past checkpoint.

    7) Stealing a maintenance key card would give you direct unscreened access to aircraft. Ramp workers aren’t checked.

    8) You could just detonate your device in the screening area where hundreds of people are waiting at the checkpoints.

    AND even if they do find a bomb strapped to a terrorist chest…..
    9) There are no real effective procedures for actually responding to a bomb detected at a checkpoint. At least not safely.

A little extra security is NOT taking your ‘Freedom’ away…the only reason people say so, is because here in the States people are so sexually repressed that the thought of some machine seeing them naked or some security guard touching their penis during a pat down bothers them on such a fundamental level (most likely because they are suppressing deep seated feelings involving fantasies where they get long strip searches by the same guard) that it triggers some sort of illogical ‘flight or flight’ response that they associate with buzzwords like ‘freedom’. Its NOT ‘Freedom’ people…..Its a FREAKIN’ PATDOWN!!! Do you think a doctor grabbing your balls is invading your ‘Freedom’?!?! No?…..And why is that?…..Oh because he’s doing it for a good reason……and gee…..airport security is what? a bad reason?……When they take away your freedom you’ll know it…Fight the fight when it’s right…this is the WRONG fight.       These measures are to get you used to the the checkpoints that are coming in the near future. Germany was much like America is becoming now before the Nazi movement took hold. Control is the name of the game.  Enjoy the concentration camps they have set up for you, I’ll be long gone.
