Unarmed Man Charged With Vicarious Assault After NYPD Trying to Shoot Him Missed and Shot Two Women Instead

blameAbby Zimet writes at Common Dreams:

So this happened: A grand jury has charged Glenn Broadnax, an unarmed, emotionally disturbed, possibly suicidal man who in September wandered into traffic in Times Square with felony assault – maximum sentence: 25 years – after NYPD officers opened fire on him in the mistaken belief he had a gun; with their usual stellar markmanship, they instead hit two women, one using a walker. Regardless, the nine-count indictment unsealed this week charged that Broadnax “recklessly engaged in conduct which created a grave risk of death.” An assistant D.A. concurred, arguing that “the defendant is the one that created the situation that injured innocent bystanders.” Really? On the conduct-creating-a-grave-risk front, many of us would take our chances with Broadnax: Statistically, the NYPD usually requires about 331 rounds to hit 54 targets, of which 14 will be innocent bystanders, 24 will be dogs, and 16 will be people they were actually aiming at. But still: Lookit what Broadnax made them do. Oh, yeah, and did we mention he’s black?

This is so rotten I can’t believe people aren’t rioting in NYC over this. Not that I’m inciting a riot or anything, I wouldn’t want to be blamed for that.

  2. Fun fact: Police are 11 times more likely than other gun owners to mistakenly shoot an innocent person.

    • But it’s their job to shoot innocent people by ‘mistake’.

      • If there’s a presumption of innocence until conviction, I guess every person the police shoots is innocent.

        • Good point, And this person is charged with a crime because the police were unable to kill him on the street. The world is upside down my friend.

Stupid cops. Those idiots shot those people and should be charged with assault, not the dude they were shooting at. The first thing I learned about guns was the fact that you must check your target before firing. Don’t shoot if you’re not going to hit it. Always know what is beyond your target in case you miss. Their ineptitude shot those people, and they should pay for it.

  4. Typical cop ineptitude, and refusal to take responsibility for their own incompetence.

I guess I’m going to have to charge all police with being incompetent pieces of shit, as well as all members of DA offices being, well just huge pieces of shit – vicariously, of course – because of these fuckers. It’ be great to get some jury nullification activism in this case.
